1. General Provisions

1.1. By registering on the online store website https://khomusko.com, you guarantee that you are of legal age and possess the necessary civil capacity to use the online store website.
1.2. In accordance with Art. 638 of the Civil Code of Ukraine, in case of agreement with the provisions set forth in the Offer and its acceptance, the Buyer undertakes to pay for and accept the Goods, and the Seller has the obligation to transfer the Goods to the Buyer (acceptance of the Offer is equivalent to concluding a contract on the terms set forth in the Offer). By accepting the Offer, a person agrees to all its terms in the form in which they are set forth in the text of this Offer and assumes the obligations set forth therein.
1.3. Proper acceptance of the Offer is considered to be filling out the corresponding electronic form placed on the Site in the "Checkout" section and/or the Buyer's payment of the full or partial cost of the ordered Goods. After acceptance, the Offer acquires the status of a contract. By accepting the Offer, the Buyer agrees to all its terms and undertakes to comply with them.
1.4. This Agreement is addressed to an unlimited number of persons and is an official public proposal of the Seller to conclude a contract of sale of Goods with Buyers remotely, photographs of which are placed at https://khomusko.com.
1.5. In case of full agreement with the terms of this Public Offer Agreement, the Buyer accepts the terms and procedure for placing an order, paying for the goods, its delivery, as well as responsibility for dishonest ordering and non-fulfillment of the terms of this Agreement.

2. Definition of Terms

2.1. Seller — Individual Entrepreneur Makarova Olga Anatoliivna, EDRPOU 3055217182, who offers any person to accept the Offer regarding the purchase of Goods and is the owner of the Goods offered on the online store website, the details of which are specified in the payment invoices and/or shipping documents.
2.2. Offer — this document containing a proposal to any person to accept it, become a Buyer, and purchase the Goods.
2.3. Acceptance — providing the Buyer's full and unconditional consent to the Seller to conclude this Agreement on the terms provided for by the Public Offer, which is formalized by one of the methods specified in this Agreement.
2.4. Buyer — a capable individual who has reached the age of 18, receives information from the Seller, places an order regarding the purchase of Goods presented on the online store website for purposes not related to the implementation of business activities, or a legal entity.
2.5. User of the online store website https://khomusko.com — a person who has access to the site via the Internet and uses it, views information and/or orders and/or receives Goods/services using technical tools of the site.
2.6. Together, the Seller and the Buyer may be referred to as the "Parties," and each separately as a "Party."
2.7. Goods — the list of assortment items published on the online store website, for which the price, name, and description of the goods are indicated, accompanied by its image.
2.8. Site — the website https://khomusko.com, where this Offer is placed and which is a means for presenting or selling goods, works, or services by making an electronic agreement in accordance with the Law of Ukraine "On Electronic Commerce."
2.9. Registration — filling out the corresponding form on the site by the User indicating the necessary data.
2.10. Personal data — information or a set of information about a physical person who is identified or can be specifically identified.
2.11. Order — the Buyer's decision to purchase Goods by properly formalizing a request for the purchase and delivery of selected Goods on the site at the address specified by the Buyer.
2.12. Buyer's Personal Account — a page of the site containing the history of formalized Orders, as well as personal information specified during registration. The personal account may also contain other information, the volume of which is determined by the Seller.
2.13. Recipient — the Buyer or a person who, on behalf of the Buyer, actually receives the Goods delivered by the Seller or the carrier company.
2.14. Material defect of the Goods — a defect that makes it impossible or unacceptable to use the Goods in accordance with its intended purpose, arose through the fault of the manufacturer (Seller), after its elimination manifests itself again for reasons independent of the consumer, and at the same time has at least one of the following signs: a) cannot be eliminated; b) its elimination requires more than fourteen calendar days; c) it makes the Goods significantly different from what is provided for in the contract.
2.15. Courier delivery — direct transfer of Goods from an employee of the delivery service or courier or forwarding service to the Buyer at the address specified by the Buyer, on paid or free terms.
2.16. Delivery Service / Carrier Company — third parties who provide services for the delivery of Orders to the Buyer.
2.17. Terms not defined in this Agreement may be used in the Agreement. In such a case, their interpretation is carried out in accordance with the content of this Agreement.

3. Subject of the Contract

3.1. The Seller undertakes to transfer the Goods to the ownership of the Buyer, and the Buyer undertakes to pay for and accept the Goods on the terms of this Agreement. This Agreement regulates the purchase and sale of goods in the online store, including: voluntary selection of Goods, independent formalization of the order, payment for the order, processing and delivery of the order.
3.2. This Agreement applies to all types of Goods presented on the site as long as such proposals with a description are placed in the online store https://khomusko.com.
3.3. The Buyer is obliged to independently familiarize themselves with the terms of this Agreement, and the Seller is not obliged to additionally inform the Buyer about its existence, except for publication on the site.
3.4. By concluding this Agreement, the Buyer confirms that they are familiar with the information about the Goods (shape, design, color, size, quality, etc.) and agrees to purchase such Goods.
3.5. Any person over the age of 18 can become a Buyer. Persons who have not reached the age of 18 may use the online store and purchase Goods only with the consent of parents or legal representatives.
3.6. The registration form filled out by the Buyer in electronic form, placed on the Site in the "Checkout" section, is an integral part of this Offer.
3.7. When filling out the registration form, the Buyer undertakes to indicate mandatory information in full and bears responsibility for its accuracy.
3.8. The territory to which the delivery of Goods can be carried out is not limited, with the exception of russia, belarus, eritrea, DPRK, syria, and temporarily occupied territories of Ukraine.
3.9. Information about the Goods placed on the Site is dynamic and can be changed by the Seller without prior notice. Such changes take effect from the moment of their publication.
3.10. Information about the Goods, terms of its purchase, prices, and other information are current at the moment of placing the order.
3.11. In case of erroneous acceptance, the Parties have the right to change the terms only on the condition of timely notification.
3.12. Acceptance of the Offer by the Buyer means the conclusion of a contract between the Buyer and the Seller.
3.13. The Seller has the right to refuse the acceptance in case of actual absence of the Goods in stock. In such a case, the rights and obligations of the Parties cease, and the cost of the Goods is returned to the Buyer.
3.14. In case of incorrect indication of e-mail or phone number, the Seller has the right to cancel such an unconfirmed acceptance.
3.15. The Seller is not responsible for the accuracy of the information provided by the User during registration.
3.16. Information about the Goods is placed directly on the Site and on its packaging. The Buyer is obliged to familiarize themselves with this information until the moment of accepting the Goods.

4. Rights and Obligations of the Parties

4.1. The Seller undertakes to post current info on the Site, transfer the Goods in the chosen method, and comply with the Offer.
4.2. The Seller has the right to transfer Goods only after acceptance and to refuse returned Goods if damage or signs of use are detected.
4.3. The Buyer undertakes to comply with the Offer and not to manufacture goods based on the Product's design.
4.4. The Buyer has the right to receive the Goods, obtain necessary info, and register a personal account.
4.5. The Seller bears responsibility for the compliance of the Goods with current standards of Ukraine.
4.6. Unjustified refusal of the Buyer to receive the Goods is a ground for returning funds minus delivery costs.

5. Cost of Goods and Payment Procedure

5.1. The cost of the Goods is indicated on the Site.
5.2. Prices on the Site are current for Ukraine. For international purchases, prices are recalculated at the Seller's constant average exchange rate.
5.3. Upon international delivery, the Buyer additionally pays the cost of delivery. The Seller pays the carrier at the expense of the Buyer.
5.4. Upon delivery within Ukraine, the Buyer pays the carrier directly.
5.5. Payment for Goods and delivery is carried out in full on the terms of prepayment.
5.6. Payment is carried out after placing the order via the link provided by the Seller.
5.7. All calculations are carried out taking into account taxes and fees.
5.8. Within Ukraine, Goods can be paid for via bank transfer, including internet banking.

6. Procedure for Acceptance and Delivery of Goods and Returns

6.1. Delivery is carried out by shipping or self-pickup.
6.2. The method is chosen by the Buyer during checkout.
6.3. Self-pickup is at: Kyiv, Tarasa Shevchenko Blvd, 1B, daily from 12:00 to 19:00.
6.4. Domestic delivery is via "Nova Poshta" (branch, parcel locker, or courier).
6.5. International delivery is via DHL, Nova Poshta, or Ukrposhta.
6.7. Shipping is within 1–3 days from acceptance. Delivery is paid by the Buyer.
6.8. Estimated international delivery is 20–30 days. The Seller is not responsible for customs delays.
6.9. Customs clearance costs and all customs payments are paid by the Buyer.
6.10. Upon receiving, the Buyer must check for damage. Claims regarding visible defects are not accepted after receipt.
6.11. Returns of high-quality Goods are possible within 14 days if the Goods are without signs of use, have tags, and packaging.
6.12. International returns require prior agreement. All return costs (delivery, customs) are borne by the Buyer.
6.13. Refunds are made to the same account used for payment within 14 days after the Seller receives and checks the Goods.
6.16. The risk of accidental damage passes to the Buyer upon transfer or to the carrier if shipped.
6.17. Non-returnable items: underwear, swimwear, hosiery, perfumes, cosmetics, gloves, fabrics, bed linen, and aroma candles.
6.19. The Seller is not responsible for non-conformity to the Buyer's subjective expectations if the Goods comply with declared characteristics.
6.20. In case of returning without packaging or with signs of use, the Seller may reduce the refund amount.

7. Liability of the Parties and Dispute Resolution

7.1. Parties are responsible for actual damages according to Ukrainian law.
7.2. The Buyer is responsible for the accuracy of order data. Additional costs due to incorrect data are borne by the Buyer.
7.3. Responsibility for money transfers lies with the banking institutions and payment systems.
7.4. The Seller is not liable for failures of Internet providers, payment systems, or banks.
7.5. The only compensation for non-conformity is the Buyer's right to refuse the Goods and demand a refund before signing for receipt.
7.6. The Seller's liability cannot exceed the cost of the Goods and does not include lost profits.
7.8. Disputes are resolved through negotiations or in court in accordance with Ukrainian law.

8. Intellectual Property

8.1. All Site content (photos, videos, graphics, text, logos, designs, trademarks) belongs to the Seller or is used on legal grounds.
8.2. The Buyer cannot copy, change, or distribute these objects without written permission.
8.5. The Seller reserves the right to use images or reviews provided by the Buyer with the @khomusko mark for marketing purposes unless the Buyer objects.
8.6. Purchase of Goods does not mean transfer of intellectual property rights.

9. Force Majeure

9.1. Parties are exempt from liability for non-performance caused by force majeure confirmed by the Chamber of Commerce and Industry of Ukraine.
9.4. The Party affected must notify the other Party within 24 hours.
9.6. If force majeure lasts for 2 consecutive months, either Party may terminate the contract.

10. Use of Buyer's Personal Data

10.1. Personal data (Name, phone, email, etc.) is confidential and processed according to the Law of Ukraine "On Protection of Personal Data."
10.2. By accepting the Offer, the Buyer consents to the processing and use of data for info and promotional materials.
10.4. The Buyer can restrict or prohibit the use of their data at any time by contacting the Seller.
10.7. Only authorized persons of the Seller and the Buyer have access to the data.
10.9. The Site uses cookies and similar technologies for analytics and performance.
10.10. To withdraw consent, the Buyer should email: dskhomusko@gmail.com with the subject "Personal Data."
10.12. The Site uses technical means (Google Analytics, Meta Pixel, UTM tags) for functionality, personalization, and advertising.

11. Term of the Contract and Procedure for its Termination

11.1. This Agreement takes effect from acceptance and is valid until full fulfillment of obligations.

12. Other Conditions

12.2. Invalidity of one provision does not affect the validity of other provisions.
12.4. The Offer is valid until withdrawn by the Seller.
12.6. The Seller has the right to make changes to the Offer without prior notice.
12.8. Communication is via e-mail and telephone; electronic messages have legal force.
12.9. The Seller may refuse service in case of systematic groundless returns or dishonest behavior.
